Distance Sales Agreement

1. Parties
This Distance Sales Agreement ("Agreement") is entered into between the parties whose information is set out below, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

Buyer information consists of the name, surname, address, phone, email, and other details declared by the buyer during the order process. This information appears in the order confirmation email and on the invoice.
2. Subject of the Agreement
The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the product(s) ordered electronically by the Buyer from the ozurgup.com website belonging to the Seller, with the characteristics specified in the agreement, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
The Buyer accepts and declares that they have read and been informed of all pre-contractual information regarding the essential characteristics of the product subject to sale, the sale price, payment method, and delivery conditions, and that they have given the necessary approval in electronic form.
3. Product Information Subject to the Agreement
The type, quantity, brand/model, color, number of units, sale price (including VAT), payment method, and delivery information of the product are stated in the order confirmation and on the invoice.
Product images are for illustrative purposes and may differ from the actual product in terms of color, shape, and packaging. The binding specifications are the technical features stated in the product descriptions.
4. General Provisions
4.1. The Buyer declares that they have read and been informed of the pre-contractual information regarding the essential characteristics of the product subject to sale, the sale price, payment method, and delivery, and that they have given the necessary confirmation in electronic form.
4.2. The product shall be delivered within the statutory period of 30 (thirty) days from the order date. If the product is not delivered, the Buyer may terminate the agreement.
4.3. The product is delivered to the Buyer or to the person/organization at the address indicated by the Buyer. Even if the Buyer is not present at their address at the time of delivery, the Seller is deemed to have fully and completely performed its obligation.
4.4. All shipping risks until delivery of the product belong to the Seller. After delivery, the Buyer assumes the risk of damage or loss.
4.5. If it becomes impossible to supply the product subject to the order, the Seller shall inform the Buyer within 3 (three) days from the date it learns of this situation and refund the amount collected within 14 (fourteen) days.
5. Rights and Obligations of the Seller
5.1. The Seller is obliged to deliver the product subject to the agreement in full, in accordance with the characteristics specified in the order, and together with warranty documents and user manuals, if any.
5.2. If the Seller is unable to fulfil its obligations arising from the agreement due to force majeure (natural disaster, epidemic, war, strike, legal regulations, etc.), it is obliged to notify the Buyer of this situation. In such case, the Buyer may request cancellation of the order and a refund.
5.3. The Seller is not obliged to verify the accuracy of the information provided by the Buyer; liability arising from incorrect information belongs to the Buyer.
6. Rights and Obligations of the Buyer
6.1. By placing an order, the Buyer is deemed to have accepted all terms of this Agreement.
6.2. The Buyer is responsible for the accuracy of the information declared during the order process. Damages arising from incorrect information belong to the Buyer.
6.3. The Buyer agrees to pay the product price and any shipping fee in the manner specified during the order process.
6.4. The Buyer is responsible for inspecting the delivered product and, in case of damaged or incomplete product, having a report drawn up in the presence of the courier officer.
7. Payment and Security
7.1. Payment transactions are processed through the iyzico secure payment infrastructure.
7.2. In credit card payments, if unlawful use by a person other than the cardholder is detected, the procedure applicable to the cardholder by the relevant bank shall be followed.
7.3. The Buyer's credit/debit card information is never stored by the Seller under any circumstances. All card data is processed through the iyzico infrastructure in compliance with PCI DSS standards.
7.4. In installment payments, the installment agreement between the Buyer and the cardholder's bank applies. The number of installments and terms are stated on the payment page.
8. Delivery Terms
8.1. Delivery is made to the address specified by the Buyer in the order form through the contracted courier company.
8.2. The delivery period is 30 (thirty) days at the latest from payment confirmation. The estimated delivery time is stated in the order confirmation.
8.3. Shipping fees may vary depending on the order total and delivery region. The shipping fee is clearly displayed on the order confirmation screen.
8.4. Delays and costs arising from the Buyer providing incorrect or incomplete address information belong to the Buyer.
8.5. Products damaged in transit must be received with a report drawn up in the presence of the courier officer. Otherwise, the Seller accepts no liability.
9. Right of Withdrawal
9.1. Pursuant to Law No. 6502 on the Protection of Consumers, the Buyer may exercise the right of withdrawal within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty.
9.2. In determining the withdrawal period:
The following shall apply.
9.3. To exercise the right of withdrawal, it is sufficient to notify the Seller within the specified period. Notification may be made by email, telephone, or through the Contact form.
9.4. Following exercise of the right of withdrawal, the Seller shall refund the full product price to the Buyer using the payment method used by the Buyer, within 14 (fourteen) days at the latest from the date of notification.
9.5. After exercising the right of withdrawal, the Buyer is obliged to return the product to the Seller within 10 (ten) days at the latest. Return shipping costs belong to the Buyer (except where the Seller offers different campaign terms).
- For products constituting a single order, the day the product is delivered to the Buyer or to a third party indicated by the Buyer,
- Where multiple products are ordered in the same order and delivered separately, the day the last product is delivered
10. Cases Where the Right of Withdrawal Cannot Be Exercised
Pursuant to Article 15 of the Regulation on Distance Contracts, the Buyer cannot exercise the right of withdrawal in the following cases:
- Products whose price varies depending on fluctuations in financial markets and is not under the Seller's control
- Products prepared in accordance with the Buyer's requests or personal needs, which by their nature are not suitable for return, are liable to deteriorate quickly, or may pass their expiration date
- Products whose protective elements such as packaging, tape, seal, or package have been opened after delivery, where return is not appropriate for health and hygiene reasons
- Products that, after delivery, have been mixed with other products and cannot be separated by their nature
- Periodicals such as newspapers and magazines, other than those provided under a subscription agreement
- Services performed instantly in electronic form or intangible goods delivered instantly to the consumer
- Audio or video recordings, books, digital content, software programs, and data recording and storage devices, where the packaging has been opened
11. Default and Legal Consequences
In credit card transactions, if the Buyer defaults, they accept that they will pay late payment interest at the rate determined by the cardholder's bank, and that this matter will be handled within the framework of the credit card agreement between them and their bank.
12. Competent Court
For disputes arising from this Agreement, Consumer Arbitration Committees have jurisdiction within the monetary limits announced annually by the Ministry of Trade; Consumer Courts have jurisdiction where such limits are exceeded.
The Seller accepts that the Buyer may apply to the Consumer Arbitration Committee or Consumer Court at the place of the Buyer's residence or where the consumer transaction took place.
13. Effectiveness
This Agreement enters into force on the date it is approved by the Buyer in electronic form. A copy of the Agreement is sent to the Buyer's registered email address together with the order confirmation.
